SINGAPORE HIGH COURT AFFIRMS DISMISSAL OF PIATCO CLAIM ON GROUND OF ILLEGALITY |

The Philippine government prevailed again against Piatco in their attempt to set aside the July 22 2010 Award in the international arbitration involving NAIA Terminal III. The government welcomed the Singapore High Court’s Decision delivered yesterday (November 15,2011) which denied Piatco's Application for Set Aside of the ICC Award rendered by a distinguished tribunal (Michael Pryles; Johnny Veeder and Florenz Reglado)arising out of the annulled Concession Agreements concerning Terminal III and ordered PIATCO to pay the costs of the proceeding. In 2003, the Philippine Supreme Court nullified Piatco’s build, operate and transfer contract over the airport for violation of bidding rules and other laws and for modifying the contracts to the disadvantage of government. Piatco sued the government before the International Chamber of Commerce (ICC) in Singapore where it sought to recover at least $565 million in damages. Its foreign investor, Fraport, separately sued the government at the International Center for the Settlement of Investment Disputes (ICSID) in Washington DC. |

Twenty-six newly naturalized Filipino citizens took their oath of allegiance to the Republic of the Philippines at the Office of the Solicitor General in Amorsolo, Makati City today, October 25, 2011. The affair was presided over by Solicitor General Jose Anselmo Cadiz together with Assistant Solicitor General Roman Del Rosario and Department of Foreign Affairs Special Assistant to Undersecretary for Administration Atty. The Special Committee on Naturalization was created pursuant to Republic Act No. 9139 or the Administrative Naturalization Law of 2000 and has the primary responsibility to approve or deny applications for naturalization. The said committee is presently under the Office of the Solicitor General. |
OSG SEEKS DOCUMENTS TO ASCERTAIN GROUNDS FOR NULLFICATION OF TORRES CLAIMS |

The Office of the Solicitor General has sent a letter to the Quezon City Assessor’s Office dated September 12, 2011, requesting for additional documents such as tax declarations to include these in the assessment of the veracity of the claims made by Mr. Wilfredo Torres to the parcels of land situated in Quezon City that covers 32,347 sq.ms. and 15,291 sq.ms., respectively. A similar letter was forwarded to the Registrar of Deeds Atty. Ernesto Quilala requesting for copies of Transfer Certificate of Titles (TCTs) and survey plans of the properties that were covered by the titles owned by Torres. This comes a few days after the OSG, in behalf of the Land Registration Authority (LRA) filed an amended complaint last September 08, 2011 against Manuel Alino, Wilfredo S. Torres and the Register of Deeds that sought the cancellation of the titles allegedly owned by respondent Wilfredo S. Torres. Torres recently attempted to seize control of the 24–hectare property in Quezon City and threatened the residents of the area. The titles owned by Torres were supposedly issued by the Register of Deeds of Quezon City in the name of one Manuel Aliño. In the said complaint, it was revealed that upon close examination, the LRA found that there were inconsistencies in the technical descriptions of the titles as well as indications of forgery. |

Letter to the Editor Abante Tonite October 07, 2011 Dear Sir, This refers to the article of Mr. Arnold Clavio published today entitled “OMG!!! OSG!!!” where he raised several issues quoted from an alleged open letter to the President written by an unidentified employee of the Office of the Solicitor General. Please allow us to clarify the issues point by point. First, with regard to the alleged “mishandling” of the SEC case, it must be stressed that the OSG simply agreed with the decision handed down by the Supreme Court in its interpretation of foreign capital. By doing so, the OSG has duly upheld the Constitution and the law and the best interest of the Republic and the Filipino People. It must be emphasized that the OSG has sufficiently defended the Constitutionality of the Truth Commission before the Supreme Court and the theory and strategy in handling the case was fully discussed with the whole legal team of the Office of the President.
