MANILA, Philippines - Solicitor General Jose Anselmo Cadiz urged Chief Justice Renato Corona to go on leave so he can focus on his impeachment trial at the Senate, which will start next week.

“I don’t think he can be effective both as a Chief Justice and as a defendant in an impeachment case, one or the other will take all of one’s time,” Cadiz told the weekly media forum Kapihan sa Diamond Hotel in Manila.

The Philippine government prevailed again against Piatco in their attempt to set aside the July 22 2010 Award in the   international arbitration involving NAIA Terminal III.  The government welcomed the Singapore High Court’s Decision delivered yesterday (November 15,2011) which  denied Piatco's Application for Set Aside of the ICC Award rendered by a distinguished tribunal (Michael Pryles; Johnny Veeder and Florenz Reglado)arising out of the annulled Concession Agreements concerning Terminal  III and ordered PIATCO to pay the costs of the proceeding.

In 2003, the Philippine Supreme Court nullified Piatco’s build, operate and transfer contract over the airport for violation of bidding rules and other laws and for modifying the contracts to the disadvantage of government. Piatco sued the government before the International Chamber of Commerce (ICC) in Singapore where it sought to recover at least $565 million in damages. Its foreign investor, Fraport, separately sued the government at the International Center for the Settlement of Investment Disputes (ICSID) in Washington DC.

MANILA, Philippines — Solicitor General Jose Anselmo Cadiz said Thursday the temporary restraining order (TRO) issued by the Supreme Court (SC) on the case involving the P35 billion Poverty Eradication and Alleviation Certificate (PEACe) bonds issued in 2001 could no longer be implemented by the government.
 
In a comment, Cadiz told the SC that on October 18, the date the TRO was issued and also the day of the maturity of the PEACe bonds, the National Treasurer and the Bureau of Treasury effected settlement of the bonds and paid out the redemption proceeds net of 20 per cent final withholding tax (FWT) pursuant to the provisions of the National Internal Revenue Code of 1997 in relation to the BIR Ruling No. 370-2011.
